Cures Act Changes Medical Records Requirements: TMA White Paper

Keep up to date with your requirements under the law when it comes to medical record releases with the Texas Medical Association’s recently updated white paper, “Patient Access and Consent to the Release of Medical Records” (TMA login required). 

TMA staff updated the white paper to reflect recent changes in the law. Most notably, as of April 2021, the information-blocking rule under the 21st Century Cures Act prohibits physicians from engaging in any practice likely to interfere with the access, exchange, or use of electronic health information. 

The white paper details how the Cures Act impacts the time limits physicians have to respond to a records request, the medium by which physicians may provide records, and more. It also explains how physicians can avoid information-blocking and comply with the law.
