EMR: Evaluation, Selection, and Legal Considerations

The need for improved health care quality, combined with the push from market forces to keep costs down, is driving all health care professionals to implement an electronic medical record (EMR) system. The following three videos address some of the common issues involved in implementing an EMR.

View the online videos, Are You Ready for an EMR?, Which EMR Is Right for Your Practice?, and Technology: Legal Issues and Vendor Contracting, as recorded at TMA's annual meeting, TexMed, in May 2006. Viewing the videos is free; however, if you would like to receive AMA PRA Category 1 CreditTM, follow the instructions below.

These videos may be viewed separately for 1 AMA PRA Category 1 CreditTM each. TMLT policy holders may view all three together for a discount on their liability insurance, as explained below.

Liability Insurance Discount

Physicians who are insured with Texas Medical Liability Trust (TMLT) may earn professional liability insurance discounts by participating in approved continuing education activities. TMLT policyholders who complete all three online courses above will earn a 3-percent discount (not to exceed $1,000), which will be applied to their next eligible policy period.

Instructions for Obtaining AMA PRA Category 1 CME CreditTM for This Activity

1) View the online videos, Are You Ready for an EMR?Which EMR Is Right for Your Practice?, and/or Technology: Legal Issues and Vendor Contracting in their entirety. (Please allow a several minutes to download.) System requirements: Windows NT® 4.0 or later, or Windows 98 or later. Microsoft Windows Media Player® 6.4 or later. Microsoft Internet Explorer 5.0 or later, or Netscape Navigator 7.0 or later. Broadband Internet connection.

2) Complete the online course evaluations for the specific course(s) taken:

Target Audience

Physicians of all specialties who are interested in implementing an EMR system. The videos are designed to educate participants about the many issues involved with selecting an electronic system including evaluation and legal considerations.

Course Objectives

Upon completion of this series, participants should be able to:

  1. Outline key issues in selecting and implementing an EMR system.
  2. Review important aspects of data ownership and vendor contracts.
  3. Recognize Stark laws and other legal issues that may affect EMR implementation.

Continuing Medical Education

The Texas Medical Association is accredited by the Accreditation Council for Continuing Medical Education (ACCME) to provide continuing medical education for physicians. 

The TMA designates this educational activity for a maximum of 1 hour of AMA PRA Category 1 CreditTM. Physicians should only claim credit commensurate with the extent of their participation in the activity.

The Texas Medical Association designates Technology: Legal Issues and Vendor Contracting for 1 credit in ethics and/or professional responsibility education.

Speakers

Are You Ready for an EMR?: Joseph Schneider, MD, chief medical information officer at Children’s Medical Center Dallas, helps guide and support the implementation of clinical information systems at Children’s. Dr. Schneider cares for patients at The University of Texas Southwestern. His academic interest is on the safety of EMRs and personal health records systems for pediatrics. Dr. Schneider is vice chair of the executive committee of the AAP Council on Clinical Information Technology; a member of the Board of Directors of the Texas Pediatric Society; chair of the Texas Medical Association Ad Hoc Committee on Health information Technology; and is a member of the Southern Governor’s Association Gulf Coast Task Force on Health Information Technology.

Laura Palmer, BS, is a practice management consultant with 15 years of experience in managing multispecialty group practices in urgent care, occupational medicine, family practice, and internal medicine. Her areas of expertise include staff recruitment, business development, and managed care contracting. She has worked in the hospital setting, diagnostic manufacturing sector, and reference laboratories. She holds a BS in medical technology from Michigan State University and has served as a trainer for continuous quality improvement programs.

Which EMR Is Right for Your Practice?: John Lubrano, PhD, is the founder and owner of Protis I.T. Solutions. For eight years, Protis has provided information technology consulting and support for professional service firms in Texas. Dr. Lubrano specializes in office automation and EHR deployment for medical practices and works exclusively with TMA Physician Services as its technology expert.

Technology: Legal Issues and Vendor Contracting: Hal Katz is board certified in health care law by the Texas Board of Legal Specialization. Mr. Katz focuses his representation on clients doing business within the health care industry. His clients include physicians, hospitals, federally qualified health centers, chiropractors, dentists, therapists, managed care organizations, mental health mental retardation centers, and hospital districts across Texas. Representation of these clients includes advising on corporate, transactional, regulatory, and public policy matters. Mr. Katz is a regular speaker on issues relating to managed care, business relationships, and health care transactions.
