As you’re very much aware, a lot has changed over the past year because of the COVID-19 pandemic, especially how you and your staff care for your patients.

It’s been almost a year since the Texas Medical Association published a Frequently Asked Questions (FAQ) document to help guide you through any concerns you might have about expanded medical leave, paid sick leave, or complying with other regulations regarding personnel.

Well, as with everything else, some of the topics covered in that original document have changed. So, we updated the FAQ with the latest information.

New details include:

  • Families First Coronavirus Response Act (FFCRA): Because the paid leave requirements under the act expired Dec. 31, 2020, FFCRA-covered employers are no longer required to provide eligible employees with paid sick leave and expanded family and medical leave for specified reasons related to COVID-19.
  • However, if you voluntarily provide FFCRA leave to eligible employees until March 31, 2021, the omnibus spending and COVID-19 relief bill that became law late last year extended employer tax credits that cover 100% of payment of those qualified wages, plus your share of Medicare tax imposed on those wages.
  • In addition, the criteria for health care personnel returning to work following confirmed or suspected COVID-19 also has been updated, per the latest Centers for Disease Control and Prevention recommendations.

Find the Human Resources FAQ document in the TMA Guides and FAQs section of TMA’s COVID-19 Resource Center, which is constantly updated with news, resources, and government guidance on the coronavirus outbreak.
