As a physician, you strive to maintain quality standards medically, professionally, and ethically.

However, despite your efforts, you may find yourself the subject of a Texas Medical Board (TMB) investigation. If so, you need to understand how your responses and actions throughout the process may affect you now and in the future.

Under the authority of the Texas Legislature, TMB is responsible for licensing and disciplining physicians, and for adopting and enforcing board rules that regulate the practice of medicine in Texas. It also has authority for disciplinary investigations and actions.

To help you understand what to do if you are subject to a TMB investigation, the Texas Medical Association has created a CME publication, Texas Medical Board Investigations: A Physician’s Guide Through the Disciplinary Process

The publication discusses TMB’s disciplinary function, along with several case studies that show conduct that could result in a TMB disciplinary action.

Specific topics include:

  • TMB priority areas for disciplinary review;
  • Settlement options;
  • Which violations get reported and how;
  • Consulting an attorney;
  • Making the process go smoothly; and
  • Cases involving physician substance abuse.

Texas Medical Board Investigations: A Physician’s Guide Through the Disciplinary Process has been accredited for 3 AMA PRA Category 1 Credits™, and 3 Ethics.

Like most of TMA’s CME programs, the publication is free for TMA members and their practice staff thanks to a generous sponsorship by the Texas Medical Association Insurance Trust.

Remember that the publication provides a general overview and is not intended to substitute for the advice of your retained legal counsel. TMA recommends consulting your retained legal counsel if you find yourself subject to a TMB investigation.
