“Off the Record” Is Off Limits

Q. Is it ever okay to talk with an attorney “off the record” regarding a medical liability lawsuit in which I am not a party? 

A. Do not “volunteer” information to an attorney even though you are not a party to the lawsuit. Instruct the attorney you are willing to cooperate within the confines of the law and the litigation process (e.g., giving deposition or testimony by subpoena). You need to protect yourself against any potential action that may result from an “off the record” conversation.
