Medicare Secondary Payer: The Texas Medical Association favors Congressional action to prohibit Centers for Medicare and Medicaid Services (CMS) from recouping payments from physicians or patients when Medicare was incorrectly identified as the beneficiary's primary insurer more than 18 months after initial payment has been made. CMS should be required to maintain a data system that tracks the insurance status of Medicare beneficiaries and provides that information be provided to medical offices in a simple, timely fashion (Council on Socioeconomics, p 176, I-94; reaffirmed CSE Rep. 3-A-04; amended CSE Rep. 2-A-14).
