Office of Inspector General Responsibility: The Texas Medical Association supports amending Section 371.1603, Texas Administrative Code, to provide the following or similar language:
The imposition of administrative actions triggers due process notice and hearing requirements.
Any physician exercising his rights of due process may enjoin the Office of Inspector General from imposing any administrative actions or sanctions until an administrative law judge at the State Office of Administrative Hearings issues findings of fact and conclusions of law.
After receiving the administrative law judge's findings of fact and conclusions of law, the Office of Inspector General shall issue final orders and rules according to the administrative law judge's findings of fact and conclusions of law (Res. 103-A-08).
