Drug Prescriptions (Patient Package Inserts): Physicians should retain the legal authority to use their knowledge, experience and professional judgment in determining appropriate medical treatment for their patients. TMA supports a physician’s ability to lawfully prescribe a drug for an indication not listed on its package insert when such treatment is in a patient’s best interest and based on sound medical judgment and scientific evidence. Legislation to allow access to patient records by government agencies only and specifically to determine whether prescribing decisions comport with FDA-approved package inserts should not be supported (Board of Councilors, p 59, A-94; reaffirmed BOC Rep. 3-A-04; amended BOC Rep. 6-A-14).
