The Texas Department of Insurance (TDI) has banned temporary agents from selling Medicare Advantage plans during the annual enrollment that ends Dec. 31. TDI says it issued the emergency rule after receiving complaints about temporary insurance agents soliciting some Medicare beneficiaries to enroll in "unsuitable" Medicare plans.
TDI defines a temporary agent as someone appointed by an insurer, an HMO, or another insurance agent to market insurance products. A permanent agent must pass an exam to market insurance products.
TDI says the emergency rule incorporates a requirement in Centers for Medicare & Medicaid Services guidelines that organizations notify it of licensed insurance agents they employ or contract with to market Medicare Advantage plans, and to notify TDI when an agent is terminated for cause.
