Time's Almost Up: File Your BCBS Claims

You may be entitled to a share of the $128 billion settlement of the national class action antiracketeering lawsuit against Blue Cross and Blue Shield (BCBS), but only if you file a claim for reimbursement by Oct. 19. The Blue Cross litigation is part of the antiracketeering lawsuit against HMOs. It focuses on the prospective relief and changes how BCBS and the other carriers do business.

Even though it is not formally named in the notice you received, BCBS Texas is part of the settlement of the lawsuit against the Blue Cross system, and you can file a claim. The confusion over whether BCBS Texas is included in the settlement stems from the fact that the settlement document lists Health Care Service Corporation (HCSC) as one of the defendants. HCSC is the parent company of BCBS Texas; thus, BCBS Texas is part of the lawsuit.

Physicians, physician groups, or physician organizations who provided covered services to any patient enrolled in or covered by BCBS plans any time between May 22, 1999, and May 31, 2007, may file claims.

More information about the Blue Cross settlement and settlements with the other for-profit HMOs named in the lawsuit is available at  www.texmed.org/rico or www.hmosettlements.com or by calling the settlement administrator at (877) 893-2643.
