Even though it is not formally named in the notice you received, Blue Cross and Blue Shield of Texas (BCBS Texas) is part of the settlement of the federal class action lawsuit against the Blue Cross system, and you can file a claim. The confusion over whether BCBS Texas is included in the settlement stems from the fact that the settlement document lists Health Care Service Corporation (HCSC) as one of the defendants. HCSC is the parent company of BCBS Texas; thus, BCBS Texas is part of the lawsuit.
You must file a claim for reimbursement [PDF] by Oct. 19 to be eligible for part of the $128 million set aside to reimburse physicians for unpaid claims.
The Blue Cross litigation is part of the antiracketeering lawsuit against HMOs. It focuses on the prospective relief and changes how BCBS and the other carriers do business.
